CAPER ARTEM TERMS OF SERVICE (TOS)

'I', 'Me', 'My' refers to the artist Caper Artem
'You', refers to the Client/ Customer
'WIP' refers to 'Work in process'These terms are to protect me as an artist, and by working with me, you are automatically agreeing to all of the terms listed below. Breaking of these terms will lead to blacklising of my services. I reserve the right to change this TOS at anytime, and updates will be posted to my social media if this occurs.GENERAL TERMS/ PAYMENT- I retain the right to refuse service to anyone for any reason.
- All prices are in AUD, unless otherwise specified.
- Payment is only accepted through PayPal.
- All payments are upfront, and payment is due within 24 hours of an invoice being issued. Failure to pay may result in loss of place in queue.REFUNDS- I offer full refunds before work has started. If any work has been started, only a partial refund will be issued.
- I do not offer 'Change of Mind' refunds after full work has been completed.
- If you continuously instst on an unfair refund, or charge back your money, you will be blacklisted from my services.ORDERING AND COMMISSION PROCESS- When submitting an order with me you must;
⦁ explain which service you are looking for.
⦁ provide a clear written/visual reference of your character.
⦁ explain or provide visual aid if you want a specific pose or theme (not applicable for artistic freedom).
- Please inquire about what I will and won't draw.
- WIP's will be sent after every part of the process (excluding 'sketch' and 'quick line') Example: you order a coloured lineart. A WIP will be sent after the sketch, then after the lineart.
- Once a sketch has been approved, no major alterations to the sketch are allowed once the lineart process has started
- A maximum of 2 alterations per each stage of development are allowed before you will incur an additional fee.
- Commission times can vary. Commissions can take up to 1 month to complete from payment.
- Set deadlines may incur an extra fee, depending on how soon the commission needs to be finished.
- I reserve the right to cancel and refund you during the commission process at any time.AFTER YOUR COMMISSION- Unless explicitly asked not too beforehand, I reserve the right to post your commission online anywhere I choose and use/modify your work as commission examples, sample images, in a price sheet, or in any other promotional images.
- If there are any issues with your commission, contact me and I will do my best to fix it.
- If the issues with your commission are to due to poor communication in the initial contact or at any stage in the commission, you may incur a fee.
- The layered file may only be kept up to a month after the commission is finished due to space. Any requested edits will only be made on a single layer if the layered file has been deleted.
- The art will be sent to you through the platform you contacted me on, or if requested, I can send it through email.
- You will recieve two versions of your commission, a watermarked and un-watermarked version.
- You may repost your commission, but must always credit me when reposting. Reposted commissions must be the watermarked version.COPYRIGHT AND HARRASSMENT- I retain copyright of all artwork made by me.
- Unless a commercial license has been agreed upon, all artwork by default comes with a personal use license.
- You may not use my work to make a profit, unless a commercial contract had been agreed upon.
- You may not edit/alter/change my work without my explicit permission.
- Harrassment or very hostile behaviour will not be tolerated. Any harrassment will lead to being blacklisted, blocked, and your commission being refunded (minus any work already done).
